These Terms of Service ("Terms") govern your use of the Sereno application ("App") provided by TYA ("we", "us", "our"). By using the App, you agree to these Terms.
1. Description of Service
Sereno is a baby monitor application that enables peer-to-peer video and audio streaming between two devices. The App includes:
- Real-time video and audio monitoring
- Push notifications for sound alerts
- Optional enhanced night vision
- Optional backup phone call alerts (requires Sereno+ purchase)
2. Important Limitations
Sereno is not a medical device and should not be used as a substitute for proper supervision of infants and children.
- The App requires a working internet connection on both devices
- Network issues, device problems, or power outages may interrupt monitoring
- Push notifications and phone calls may be delayed or fail due to factors outside our control
- Always ensure your child's safety through appropriate in-person supervision
3. User Responsibilities
You agree to:
- Use the App only for lawful purposes (monitoring your own children or with consent of legal guardians)
- Not use the App for surveillance of individuals without their knowledge and consent
- Maintain adequate supervision of children and not rely solely on the App
- Keep your devices charged and connected during monitoring sessions
- Provide accurate information when using paid features
4. Purchases and Payments
4.1 Sereno+
Sereno+ is a one-time purchase that unlocks:
- Permanent access to enhanced night vision
- 50 backup phone call credits
4.2 Additional Call Credits
You may purchase additional phone call credits as needed. Credits do not expire.
4.3 Payment Processing
All purchases are processed through Google Play. Refunds are subject to Google Play's refund policy.
5. Free Trial
New users receive a 10-day free trial of enhanced night vision. No payment information is required for the trial. After the trial period, enhanced night vision requires a Sereno+ purchase.
6. Intellectual Property
The App, including its code, design, and content, is owned by TYA and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
7. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The App will be uninterrupted or error-free
- Notifications or calls will always be delivered
- The App will meet your specific requirements
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TYA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.
Our total liability for any claims arising from use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold TYA harmless from any claims, damages, or expenses arising from your misuse of the App or violation of these Terms.
11. Modifications
We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify users of significant changes through the App.
12. Termination
We may terminate or suspend your access to the App at any time for violation of these Terms. You may stop using the App at any time by uninstalling it from your devices.
13. Governing Law
These Terms are governed by the laws of France. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lyon, France.
If you are a consumer in the European Union, you retain any mandatory protections provided by the laws of your country of residence.
14. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
